Law Firm "Pleshakov, Ushkalov and partners" informs Law Firm "Pleshakov, Ushkalov and partners" informs that on November 22, 2011 the State Duma of the Russian Federation enacted Federal Law No. 427-FZ "On alteraton of Articles 2 and 3 of the Federal Law "On enactent of the Land Code of the Russian Federation" and stand-alone legisation acts of the Russian Federation" signed by the President of the Russian Federtion on December 12, 2011, that introduced important amendments on regulation of issues of accrual and termination of land title related to the land in state or municipal ownership.

The company «Best Lawyers» carries out the third year research of the Russian market, making a list of the best expert - lawyers and «best of the best». This year the final list included 281 lawyer from 70 companies and advocate bureaus (in the past — 287 and 62 accordingly).
The majority of the companies are Russian or are based in Russia, but in the first five positions foreigners (see the table) dominate. Since last year this list has not undergone radical changes.
Nineteen lawyers are recognized as «best of the best» in profile nominations — this list was almost completely updated. Last year the list included 13 persons, and only three of them have held their positions — Henry Reznik, Sergey Pepeljaev and Konstantin Osipov. There are also more lawyers from the Russian companies at the present moment — eight of 19 lawyers (last year there were only two lawyers from Russia).

A regular IV-th annual IBA conference, Managing the law company: a strategy for development of global and independent law companies, took place in Moscow on November 25-26, 2010.

The final ranking called The Best Lawyers in Russia (by practice area) included 287 specialists from Moscow and Saint-Petersburg law companies. The ranking was based on rates given to the practicing lawyers by their colleagues. In total, 573 persons from 66 companies were nominated, 3672 rates were given and the final list included 287 lawyers. Only 13 out of them (from Moscow and Saint-Petersburg) were called The Best Russian Lawyers of 2010, as they gained rates high enough to be called “the crème de la crème”.
On June 4-5 an International Legal Conference took place in Moscow. The conference was devoted to commercial contracts and settlement of disputes during economic crisis. The representatives of the Russian Chamber of Commerce and Industry, International Federation of Commercial Arbitration Institutes, English-Russian Legal Association, State and Law Institute of the Russian Academy of Sciences, such law companies as SJ Berwin, Lovells CIS, Egorov, Puginsky, Afanasyev and partners, Goltsblat BLP, Clifford Chance, Allen&Overy, Vinge, Baker&McKenzie, Norton Rose Group and other participated in the conference.
On May 26, 2009, a panel discussion named The Problems of Changes into the Law On Limited Liability Companies arranged by the magazine Aktsionerny Vestnik jointly with Institute for Corporate Development was held in Moscow.
On May 26-28 the 3rd Annual Summit of Russian Corporate Lawyers took place in Moscow. The reporters were representatives from Troika Dialog, GoltsblatBlp, Principium, EastCapital, Magisters and other companies.
On March 24, 2009, the Presidium of the Supreme Arbitration Court of the Russian Federation completely annulled all judicial acts enacted in relation with case No. À066-7642/2006-23n.r. (the decision of the Arbitration Court for Astrakhan region of March 14, 2008; the decree of the Twelfth Arbitration Appellation Court of June 11, 2008, and the decree of the Federal Arbitration Court for Volga region of August 21, 2008) and made a new decision refusing in satisfaction of complaints from LLC Gazprom Dobycha Astrakhan to OJSC Yuzhnaya Neftyanaya Kompaniya and regional unit of the Russian Federal Service for Financial Markets in the South-Eastern Region (third parties are JPM Partners LDC, LLC AKO-Audit, OJSC Registrator-NIKoil).
On February 20, 2009, the fifth annual legal forum, Development of Legal Services Market in Ukraine – 2009 was held in Kiev, Ukraine. Over 80 lawyers from Ukraine, Russia and other foreign countries participated in the forum.
The international workshop on administrative and juridical applications of TIR system took place in Ankara on January.
By the decisions of Federal Customs Service funds amounting to the sum of guarantee were written off from the ASMAP operating account without legal proceedings as a repayment of carriers’ liability related with making of customs payments based on breach of TIR procedure.
Earlier on we notified our readers that the Decree of the Presidium of the Supreme Arbitration Court of the Russian Federation of December 11, 2007, under case No. 10341/07, made upon ASMAP application, left with the decree of the Ninth Arbitration Appellation Court of November 20, 2006, refusing the Federal Customs Service in satisfaction of all claims concerning collection of guarantee amounts under all 605 TIR transportations from ASMAP, without any changes.

The Supreme Court of the Russian Federation by its Resolution No.
GKPI-1154 of May 16, 2008 held invalid from the commencement date of
the court decision Para. 2.2 of Order No. 07-113/pz-n of December 27,
2007 “On Requirements to the Procedure of Maintaining the Register of
Registered Securities Holders by Registered Securities Issuers”, under
which the personnel of the registered securities issuer maintaining the
register of securities holders on its own shall include at least one
employee having a qualification certificate of the financial market
specialist maintaining the register of securities holders.
Judges of the Supreme Arbitration Court of the Russian Federation recommend that federal arbitration courts of districts sustain claims of members of limited liability companies for making other members of such company and the company itself approve a resolution on amendment of constituent documents of the company related to the change in the composition of members of the company and the change of the amount and par value of shares they hold in the authorized capital of the company in the event when claimants purchased shares in the authorized capital of the company in accordance with the laws and defendants refuse to include purchasers into constituent documents of the company.
When determining if the transaction entered into by the company is a major one, or what body of the company must approve a related party transaction, the value of the property being the subject matter of the transaction must be compared to the book value of the company's assets determined in accordance with its accounting data as of the latest day of the month preceding the closing date of the transaction.
